CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from 926 North 8th, Inc., a perpetual easement for street pipeline purposes over, under, and across the lands legally described on Exhibit A attached to Exhibit 1 and depicted on Exhibit B attached to Exhibit 1, at no cost to the City.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a perpetual easement for street purposes from 926 North 8th, Inc. over, under, and across property located at the intersection of 20th Avenue West and Lower Michigan Street, at no cost to the City.
In connection with the State of Minnesota, Department of Transportation’s upcoming Twin Ports Interchange project, the City reviewed its real estate interests and discovered that a small triangle piece of land being used for the street and sidewalk was outside of the City’s right-of-way. The acceptance of this easement allows for the City and public’s continued use of an existing sidewalk, as well as allow the City to perform any maintenance, repairs or removal of said sidewalk if such actions need to be performed.
