CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a three-year non-exclusive use agreement, substantially in the form attached as Exhibit 1, with the Eastern Little League of Duluth, Inc. for use of Como Park Baseball Fields, John Baggs Memorial Baseball Field, and Tony Emanuel Baseball Field for its youth baseball league.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a three-year agreement with the Eastern Little League of Duluth, Inc. (“ELL”) for use of Como Park Baseball Fields, John Baggs Memorial Baseball Field, and Tony Emanuel Baseball Field (“Fields”) for its youth baseball program. The Fields are located at the Woodland Community Recreation Center and Glen Avon Park. ELL may use the Fields between April 1 and July 31 during each year of this agreement on a non-exclusive basis. However, ELL shall have exclusive use of the Fields on certain days and times as indicated in the agreement.
There is no usage fee associated with this agreement because ELL uses the Fields on a non-exclusive basis and performs general ball field and lawn care maintenance duties, including but not limited to raking, mowing, trimming, fertilizing, and watering. ELL is also responsible to prepare the Fields for its practices and games, which duties include infield dragging, chalking, and ag-lime application. In addition, ELL is responsible to maintain the Fields in a clean and orderly condition and shall pick up all paper, garbage, and other debris generated from its use.
