CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to enter into Agreement 1044549, substantially in the form of the attached Exhibit A, to maintain the public sidewalk to be constructed as part of the London East development project on London Road within the plat of London East and southwest to 36^th Avenue East.

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the city of Duluth to enter into an agreement with MnDOT to maintain the sidewalk to be constructed as part of the London East development project on London Road.  As with all new sidewalk constructed in MnDOT’s right-of-way, the policy is to require the government entity to maintain the new sections of sidewalk installed.  The city has drafted a maintenance agreement with London East Homeowners Association and London East, LLC to ensure they, the adjacent property owners, will be responsible for snow removal.  This agreement is on the council agenda under 21-0463R.
