CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to enter into an agreement, substantially in the form of the attached Exhibit A, to maintain the public sidewalk to be constructed as part of the London East development project on London Road within the plat of London East and southwest to 36^th Avenue East.

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the city of Duluth to enter into an agreement with London East Homeowners Association, Inc. and London East, LLC to maintain the sidewalk to be constructed as part of the London East development project on London Road.  On July 20, 2020, the city council authorized a development agreement with London East LLC setting forth terms and conditions relating to the replatting of property located on the north side of the 3700 and 3800 blocks of London Road.  A homeowners association was established to maintain commonly used site features, including the sidewalk.  The developer will also install a public sidewalk in the London Road right of way extending from the easterly end of the development to 36^th Avenue East to provide pedestrian access from the development to the city sidewalk network and nearby Lakewalk.
