RESOLUTION AUTHORIZING AN AMENDMENT TO A THREE-YEAR AGREEMENT WITH ARROWHEAD YOUTH SOCCER ASSOCIATION FOR THE USE AND OPERATION OF THE SOCCER FIELDS AT LAKE PARK FIELDS ATHLETIC COMPLEX, ARLINGTON ATHLETIC COMPLEX AND GARY-NEW DULUTH PARK.

CITY PROPOSAL:

WHEREAS, on or about December 17, 2018, the city and Arrowhead Youth Soccer Association (“AYSA”) entered into an agreement for the use and operation of the soccer fields at Lake Park Fields Athletic Complex and Arlington Athletic Complex (the “Agreement”), with an annual usage fee of $19,669, subject to an annual 3% increase (the “Fee”).

WHEREAS, the Agreement was approved by the city council on December 10, 2018 under Resolution No. 18-0811.

WHEREAS, the City and AYSA previously entered into an agreement for the use and operation of the soccer fields at Gary-New Duluth Park, which agreement expired on December 19, 2019.

WHEREAS, AYSA did not operate its youth soccer program in 2020 due to COVID-19, nor receive any revenue, but still paid the Fee for the Agreement.

WHEREAS, the city and AYSA desire to amend the agreement to: (i) add the soccer fields at Gary-New Duluth Park to the Agreement and (ii) reduce the Fee by 50% in 2021 due to AYSA’s financial hardship from COVID-19.

NOW, THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to enter into an amendment to a three-year agreement, substantially in the form attached as Exhibit 1, with AYSA for the use and operation of the soccer fields at Lake Park Fields Athletic Complex, Arlington Athletic Complex and Gary-New Duluth Park.

FURTHER RESOLVED, that the Fee for 2021 shall be reduced by 50%; funds received under this agreement shall be deposited into Fund 205-130-1221-4625 (Parks, Community Resources, Park’s Maintenance, Rent of Athletic Fields).

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes the city to enter into an amendment to the three-year agreement with Arrowhead Youth Soccer Association (“AYSA”) for the use and operation of the city’s soccer fields at Lake Park Fields Athletic Complex, Arlington Athletic Complex Jean Duluth and Gary-New Duluth Park.  Under the terms of the agreement, AYSA manages the use of the fields by AYSA and other soccer groups. Duties include management of games and tournaments, scheduling of fields, hiring of referees, coaches, and other personnel, provision of utilities and restrooms. The City’s role is to oversee AYSA’s work and provide turf maintenance services such as mowing, aeration, and irrigation system maintenance. 

 

AYSA has managed the use of these fields for many years and desires to continue its relationship with the city to provide a quality soccer program for youth within the city of Duluth and surrounding communities.

 

Since the agreement commenced in 2019, AYSA paid the city an annual usage fee of $19,669 with an annual increase of 3%.  The fee for 2021 will be reduced by 50% due to AYSA’s financial hardship from COVID-19, with the reduced amount equaling $13,041.78.  The agreement will expire at the end of 2021.

 

The agreement provides that AYSA shall be eligible to receive an annual fee credit up to $5,000 in exchange for AYSA’s eligible improvements at Lake Park Fields Athletic Complex, Arlington Athletic Complex Jean Duluth and Gary-New Duluth Park or other city-owned soccer fields that are consistent with the city’s parks maintenance and operation strategy.  The credit shall be calculated as follows: for every $3 invested as eligible improvements by AYSA, AYSA shall receive a $1 credit, up to a total of $5,000 annually.  Such credit shall be applied to the following year’s annual fee, except that any credit due to AYSA for the final term of the use and operations agreement shall be provided to ASYA in the form of a check upon the expiration of the agreement.  AYSA does not anticipate making improvements to any soccer fields or being eligible for a fee credit in 2021.
