RESOLUTION RESCINDING RESOLUTION #20-080R AUTHORIZING AN INTERIM USE PERMIT FOR A VACATION DWELLING UNIT, SUBJECT TO CONDITIONS.

CITY PROPOSAL:

 

WHEREAS:

a)                     City council adopted Resolution # 20-0802R on November 9, 2020 approving the issuance of an Interim Use Permit to Sarah & Seth Maxim for a Vacation Dwelling Unit consisting of two bedrooms on the premises located at 5330 East Superior Street;

b)                     Sarah & Seth Maxim has applied for two vacation dwelling unit permits to reconfigure the Vacation Dwelling Unit in Paragraph a) into two Vacation Dwelling Units;

c)                     Planning commission, at their July 13, 2021 regular meeting has reviewed the petition for creation of the new Vacation Dwelling Units from the Vacation Dwelling Unit in Paragraph a) and recommends approval of  new Vacation Dwelling Unit permits for the two newly-reconfigured Units;

Resolutions Nos. 21-0569R and 21-0571R are before the city council for consideration of approval for Vacation Dwelling Unit permits for the two newly-reconfigured Vacation Dwelling Units at 5330 East Superior Street.

                      RESOLVED, that, if the city council approves Resolutions Nos. 21-0569R and 21-0571R, Resolution # 20-0802is hereby rescinded

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution rescinds resolution #20-0802R granting Sarah & Seth Maxim an interim use permit for a 2-bedroom vacation dwelling unit at 5330 East Superior Street. 

The site is located in the F-2 Low-Rise Neighborhood Mix form district. Consistent with UDC provisions, there is not a restriction on the total number of vacation dwelling units on property located in form-based zoning districts.
