RESOLUTION APPROVING SETTLEMENT IN THE AMOUNT OF $43,532.73 TO KIPPY CUYPERS FOR DAMAGE, PERSONAL INJURY, AND ALL OTHER CLAIMS.

CITY PROPOSAL:
RESOLVED, that the city council approves settlement in the amount of $43,532.73 of all claims or causes of action asserted by Kippy Cuypers, pursuant to a settlement agreement, attached here to as Exhibit A, and further authorizes the proper city officials to take all actions necessary to conclude this matter on a full, final and complete basis; payment to be made from Fund No. 610-036-1651-5841 (Self Insurance Liabilities, Insurance Accounts, Insurance General City, Liability Claims Expense).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes settlement with Kippy Cuypers against the city arising out of an incident that took place on or about January 18, 2020, at or near N. 6th Avenue E. and 2nd Street, Duluth, Minnesota wherein Mr. Cuypers alleges that he suffered injuries and damages. The city has fully investigated the negligence and damages claims and defenses asserted in this matter. The administration and city attorney recommend approval of this settlement agreement.
