RESOLUTION AUTHORIZING A TEN-YEAR LEASE AGREEMENT WITH THE STATE OF MINNESOTA, DEPARTMENT OF TRANSPORTATION, FOR THE USE OF CERTAIN HIGHWAY PROPERTY IN CONNECTION WITH KEENE CREEK PARK, AT NO COST TO THE CITY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute a ten-year lease agreement, substantially the same as the agreement attached as Exhibit 1, with the state of Minnesota, department of transportation, for the use for certain highway property in connection with Keene Creek Park, at no cost to the City.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a ten-year lease agreement with the state of Minnesota, department of transportation (“MnDOT”), for the use for certain highway property in connection with Keene Creek Park, at no cost to the City (MnDOT will not charge the City rent).
The city has operated and maintained Keene Creek Park, located in the Irving neighborhood, for a number of years (without an agreement from MnDOT). The majority of Keene Creek Park is within MnDOT’s property underneath I-35 year Grand Avenue between 60th and 62nd Avenues West. The finalization of this lease agreement formalizes the city’s long-standing use of MnDOT’s property.
Under the terms of the agreement, the City shall, at its own cost, be responsible to operate and maintain Keene Creek Park in a safe, careful, and proper manner and shall only use MnDOT’s property for park and trail purposes. The City may not conduct commercial activities within Keene Creek Park or permit use within the park for camping, sleeping or lodging purposes.
