CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from The Ledges On Lake Superior Homeowners' Association, Inc., a Minnesota nonprofit corporation, a perpetual easement for public recreational, walkway, and trail purposes under, over, upon, across, and along the real property legally described Exhibit A attached to Exhibit 1 and depicted on Exhibit B attached to Exhibit 1, at no cost to the city.


Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a permanent easement for public recreational, walkway, and trail purposes The Ledges On Lake Superior Homeowners' Association, Inc. ("Ledges") under, over, upon, across, and along real property located in the Endion neighborhood, at no cost to the city.

Under Resolution No. 21-0369, as amended by Resolution No. 21-0595, the City and Ledges entered into an agreement for the exchange of easements (the "Agreement"). The City granted to the Ledges an easement for erosion control purposes, and the Ledges needs to grant to the City an easement for trail purposes in connection with future improvements to the Lakewalk to upgrade a certain section to Americans with Disabilities Act (ADA) accessibility standards. The Lakewalk easement could not be granted at the same time the City granted the erosion control easement because the easement area needed to be designed and surveyed. The preliminary design and survey are now complete and the parties are ready to finalize the easement.
