CITY PROPOSAL:

The city of Duluth does ordain:
Section 1. Under the authority of Section 100 of the 1912 Home Rule Charter of the city of Duluth, as amended, and subject to the conditions, limitations and restrictions hereinafter set forth, permission is granted to WB Ibiza, LLC, and its successor(s) in interests, referred to herein as the permittee, to maintain an existing stairwell located directly adjacent to 2801 West Superior Street as shown in Exhibit A and legally described in subsection below and as shown in Exhibit B:

All the part of 8th Street, also known as Oak Street, UPPER DULUTH, LAKE AVENUE, according to the recorded plat thereof, St. Louis County, Minnesota, described as follows:

A parcel of land lying within the platted right of way of 28th Avenue West, Marine Division of Duluth, according to the recorded plat thereof, St. Louis County, Minnesota, described as follows:
Commencing at the Southeasterly corner of Lot 17, Block 19 said Marine Division of Duluth; then North 48 degrees 19 minutes 59 seconds West, along the Northeasterly line of said Lot 17 for a distance of 9.38 feet to the point of beginning of the parcel herein described; thence North 48 degrees 19 minutes 59 seconds West, along said Northeasterly line 15.55 feet; thence North 41 degrees 40 minutes 01 seconds East 4.67 feet; thence South 48 degrees 19 minutes 59 seconds East 15.55 feet; thence South 41 degrees 40 minutes 01 seconds West 4.67 feet to the point of beginning. Said parcel contains 73 square feet.

Section 2. Before this ordinance shall be effective for any purpose whatsoever, the permittee shall file with the planning and development division (file no. PL21-200) a certification of insurance approved as to form by the city attorney evidencing that the permittee has in forc...
