CITY PROPOSAL:
RESOLVED, that the proper city officials are authorized to express support of an agreement between Gardner Builders and St. Germain's Glass, Inc. for historic window replacement on behalf of the Burnham Apartment Project in an amount not to exceed $303,709.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution expresses support of an agreement between Gardner Builders and St. Germain's Glass, Inc. for historic window replacement on behalf of the Burnham Apartment Project (former St. Louis County Jail) in an amount not to exceed $303,709.

The City of Duluth (City) and New Burnham, LLC (Developer) submitted a cooperative grant application to the Minnesota Historical Society (MHS) in September, 2021 for Historic St. Louis County Jail Window Restoration (the "Project") as approved by city council via resolution 21-0522R. As the lead agency for this cooperative application, the City is responsible for adhering to all procurement requirements of both MHS and the City, thus the City's issuance of a bid request on behalf of the Developers construction management firm, Gardner Builders.

The complexity of historic restoration necessitated the City and Developer's decision to bid the project using best value procurement versus lowest responsive bid, which process requires council approval of award recommendation per section 41-23.1 of Duluth City Code. While the City will not enter into an agreement with St. Germain's Glass, Inc., the bid process ensures compliance with City and State procurement regulations.
