CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from Unique Opportunities Land Holdings LLC, a Minnesota limited liability company, a perpetual easement for pedestrian purposes over and across the real property legally described on Exhibit A attached to Exhibit 1 and depicted on Exhibit B attached to Exhibit 1, at no cost to the city.

 

 

Statement of Purpose

STATEMENT OF PURPOSE: 

 

This resolution authorizes the acceptance of a permanent easement for pedestrian purposes from Unique Opportunities Land Holdings LLC, a Minnesota limited liability company ( “Grantor”) over and across certain real property located in the Duluth Heights neighborhood, at no cost to the city. 

 

Under Resolution No. 21-0703, the City Council authorized a development with Unique Opportunities, LLC relating to the platting and development of a project located south of Arrowhead Road and Stanford Avenue.  Unique Opportunities, LLC will be conveying the property to Grantor at the end of the month.  One of the requirements in the development agreement is the granting of this easement.  Grantor will sign this easement once it is owned by the entity and the City will record this easement in the St. Louis County real estate records.  Grantor will be responsible to fulfill all other terms and conditions in the development agreement.
