CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute an amendment to the agreement with Confluence, Inc. for DECC waterfront landscape architectural design services for an increase of $319,120.00 , and a new total not to exceed $401,110.00, payable from fund 450-030-5530-CP450-20BOND-SEAWLL (capital improvements, finance, improvements other than buildings, capital projects, other fund contributions, MN state bonds 2020, seawall phase II (behind DECC)).

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes an amendment to an agreement with Confluence, Inc. for DECC waterfront landscape architectural design services for an increase of $319,120.00 and a new total not to exceed $401,110.00. Under the amended contract, Confluence will complete final design-development drawings for the project. The work will build upon the existing predesign and include new construction cost estimates to inform final project financing decisions. This phase of design work will be paid for with City funds put aside for coastal infrastructure improvements at the DECC, the Lakewalk, and Brighton Beach.

The City expects to execute a final funding agreement with the State of Minnesota early this spring authorizing the state to reimburse the City for expenses occurred on this project. Following execution of the funding agreement, staff expects to bring the contract with Confluence back to City Council to approve an additional amendment authorizing additional state-funded services including construction drawings, bidding, construction survey and layout, and construction administration and inspection

 

Along with companion resolution 22-0091, this resolution authorizes complete design services to reconstruct the storm-damaged DECC seawall and convert the adjoining flat space to be a waterfront public plaza with bike and pedestrian paths, park amenities, landscaping, event spaces, and accommodations for vendors and food trucks. The seawall will be reconstructed so as to allow large cruise ships and other deep draft vessels to moor and embark and disembark passengers. The conceptual design attached as Exhibit B has been presented to the community, stakeholders, and the Parks and Recreation Commission.

The paired seawall and plaza projects are part of the coastal infrastructure rehabilitation project approved for $13.5 million of state bonding support in the 2020 legislative session under the heading, “Duluth Seawall and Surface Improvements.” The estimated $19,753,010 seawall and waterfront plaza project will be paid for with $13.5 million of state bonding support, $2.6 million of federal support, and $3.6 million of local government investment.

The complete plan for reconstruction of the DECC seawall and plaza, as well as portions of the Lakewalk and Brighton Beach, will be presented to a City Council Committee of the Whole in February.
