RESOLUTION AUTHORIZING A DEVELOPMENT AGREEMENT WITH THE CITY OF DULUTH REGARDING THE ACQUISITION AND REDEVELOPMENT OF A PART OF THE LESTER GOLF COURSE PROPERTY

CITY PROPOSAL:
WHEREAS, on November 22, 2021, the Duluth City Council approved resolution 21-0888 stating its intention to convey approximately 37 acres of park property owned by the City of Duluth ("City") currently occupied by the Lester Park Golf Course, which property is legally described on the attached Exhibit A (the "Property") for the purpose of facilitating the redevelopment of the Property for housing and related purposes;

WHEREAS, the City wishes to convey the Property to the Duluth Economic Development Authority ("DEDA"), because it is best equipped to facilitate future development of the Property;

WHEREAS, on December 20, 2021, the City approved Ordinance No. 21-069 O authorizing the conveyance of the Property to DEDA subject to the parties entering into a development agreement substantially in the form of that attached hereto as Exhibit B setting forth the terms, conditions, and goals for the public resale and redevelopment of the Property by DEDA.

NOW, THEREFORE, BE IT RESOLVED, that the proper DEDA officials are hereby authorized to purchase the Property from City and execute a development agreement with City, substantially the same as the agreement attached as Exhibit B, for the public resale and redevelopment of the Property.

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the acquisition of approximately 37 acres of park property located within Lester Park Golf Course, as shown in Exhibit A, from the City of Duluth for the development of housing and commercial activity.
