CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the County of St. Louis, on behalf of the State of Minnesota, a perpetual easement for street and utility purposes over, under, and across the real property described and depicted on Exhibit A to the attached Exhibit 1. 

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for street and utility purposes from County of St. Louis, on behalf of the State of Minnesota over, under, and across tax-forfeited property located adjacent to Skyline Parkway (north of Highway 2) for $150.00. 

 

The City has been working with Crawford Excavating LLC on its development project more commonly known as Skyline View Estates.  The City’s Development Agreement with Crawford Excavating LLC was approved under Resolution No. 22-0149.  In connection with the development, there is a storm pipe to be installed within the development that will traverse east underneath Skyline Parkway and exit into the proposed easement area.  The pipe will be owned and maintained by the City of Duluth, so the City needs to obtain this easement in order to have full control of the area the pipe lies within.  Additionally, a portion of the existing Skyline Parkway lies outside of the City’s right-of-way, and the acceptance of this easement allows for the continued use and maintenance of the road.
