CITY PROPOSAL:

RESOLVED, that the proper city officials are authorized to amend agreement L30627 with Minnesota Land Trust (MLT) for professional services for the Grassy Point Restoration Project (the Project) to increase the agreement amount from $35,000 to the correct amount of $45,000 payable from fund 452-030-5535-HANDHTAX-1527-04 (Tourism and Recreational Projects, Finance, Non-Capital Improvements, Half and Half Tax Projects, Neighborhood Parks, Grassy Point).

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes amending agreement L30627 with the Minnesota Land Trust (MLT) to increase the agreement amount from $35,000 to the correct amount of $45,000 for professional services associated with the Grassy Point project. The City of Duluth has a recreational trail system at Grassy Point which will be modified and expanded as a part of this project.  The City is making a financial contribution to this project, to cover our share of the impacted and expanded trail system. 

Agreement L 30627 was executed April 4, 2022 for the City’s financial contribution to the project in the incorrect amount of $35,000.  MLT identified the error in the contract amount, provided substantiating materials to support the correction (attached as Exhibit A), and requested an amendment.  The City agrees the original contract amount was an error, and wishes to amend the contract to the correct amount of $45,000.

MLT is responsible for all project bidding, permitting, contractor procurement, and construction management.
