RESOLUTION CLARIFYING DULUTH RESIDENCY REQUIREMENTS FOR CITY COUNCIL CONFIRMATIONS OF MAYORAL APPOINTMENTS TO THE DULUTH AIRPORT AUTHORITY BOARD OF DIRECTORS.

CITY PROPOSAL:
WHEREAS, the Laws of Minnesota, 1969, Chapter 577, Section 3, Subdivision 3 provides that all appointments to the Duluth Airport Authority board of directors shall be made by the mayor of Duluth with approval of the city council, evidenced by resolution; and
WHEREAS, Resolution No. 01-0324, Resolution Declaring Council's Policy on Residency of Members of Boards and Commissions, provides that the city council shall only confirm mayoral appointments to Duluth boards and commissions who are Duluth residents unless special exception is made by the city council; and
WHEREAS, Minnesota law, the city of Duluth Charter, and Duluth City Code do not require Duluth Airport Authority board members to be Duluth residents; and
WHEREAS, the Duluth Airport Authority board of directors oversee Duluth International Airport and Sky Harbor Regional Airport with service areas including Northeast Minnesota and Northwest Wisconsin; and
WHEREAS, the Duluth Airport Authority board of directors approved a resolution on April 12, 2022 formally requesting that the city council modify Resolution No. 01-0324R in regards to confirmation of mayoral appointments to provide that Duluth residency not be required for three of their seven directors.
RESOLVED, that the city council may confirm the mayoral appointments of up to two members to the Duluth Airport Authority board of directors who are not Duluth residents so that no more than two of the seven Duluth Airport Authority board directors are nonresidents of Duluth at any particular time;
RESOLVED FURTHER, that this resolution shall supersede Resolution No. 01-0324R regarding all appointments to the Duluth Airport Authority Board of directors.
