RESOLUTION REVERSING THE PLANNING COMMISSION'S DECISION TO APPROVE AN INTERIM USE PERMIT FOR A VACATION DWELLING UNIT AT 120 ASPEN LANE.

CITY PROPOSAL:

RESOLVED, that the city council finds as follows:
(a) On March 2022, Predictable LLC submitted an application (Planning Commission File No. "PL 22-039", staff report attached as Attachment A) for an interim use permit for a vacation dwelling unit;
(b) That a sufficient petition was filed with the city requesting the vacation described in (e) below; and
(c) Pursuant to Section 100 of the City Charter and Section 50-37.10 of Chapter 50 of the Duluth City Code, as amended, such petition was duly referred to the city planning commission and such commission gave due notice of public hearing and did consider same in a public hearing and the city planning commission approve the interim use permit; and
(d) The city planning commission, at a Tuesday, April 12, 2022 regular meeting, approved the interim use permit; and
(e) On April 22, 2022 the city received an appeal from Elizabeth Storaasli and Mark Knutson, a copy of which is attached as Attachment B, appealing the planning commission's approval of applicant's application;
(g) That the granting of the applicant's application will permit a commercial use in this neighborhood which will have a negative impact on the neighborhood.
(h) That the granting of applicant's application will negatively impact the availability of affordable housing for permanent residential use in the neighborhood and the city.
(f) The city council heard the appeal at its May 23, 2022 meeting;
FURTHER RESOLVED, that the decision of the planning commission is hereby reversed for the reasons set forth above.
