CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a twenty-year agreement, substantially in the form attached as Exhibit A, with St. Louis and Lake Counties Regional Railroad Authority for the construction maintenance, inspection, repair, replacement and use of specific areas of railroad property in connection with the Lakewalk, at no cost to the City.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the city to enter into a twenty-year agreement with St. Louis and Lake Counties Regional Railroad Authority (the "Railroad Authority") for the construction maintenance, inspection, repair, replacement and use of specific areas of railroad property in connection with the Lakewalk, at no cost to the City. This agreement generally covers the stretch of the Lakewalk between 2nd and 20th Avenues East and includes three pedestrian overpasses: one east of the Fitgers Complex (next to the Portland Malt Shoppe) and two by Leif Erickson Park.

In 1989, the Railroad Authority granted a permit to the City for the portion of the Lakewalk generally located between 5th and 14th Avenues East, plus two pedestrian overpasses (the "1989 Agreement"). The City has plans to reconstruct certain portions of the Lakewalk on property owned by the Railroad Authority between 5th and 14th Avenues East, but also in additional areas owned by the Railroad Authority that are not covered under the 1989 Agreement.
