RESOLUTION AUTHORIZING PROFESSIONAL SERVICES AGREEMENT WITH THE DULUTH TRANSIT AUTHORITY TO PROVIDE LEGAL SERVICES.

CITY PROPOSAL:
WHEREAS, Minnesota Statutes Section 458A.26, Subdivision (d) provides that Duluth City Attorney shall be the attorney for the Duluth Transit Authority; and the Duluth Transit Authority shall reimburse the city for all charges and costs incurred by the city.
RESOLVED, that the proper city officials are hereby authorized to enter into a professional services agreement, substantially in the form attached hereto as Exhibit A, authorizing City Attorney’s Office employees to provide professional legal services to the Duluth Transit Authority and further authorizing the city to be paid for such services, with revenues to be deposited into fund number 110-110-1104-4319 (General, Legislative and Executive, Attorney and Human Rights, Attorney Services).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the execution of a professional services agreement with the Duluth Transit Authority (DTA) for legal services. The City Attorney’s Office is currently invoicing DTA for legal services without a written agreement in place. The DTA shall pay $176.36 per hour to City pursuant to this agreement, which is the 2022 hourly rate set by the fee schedule set by Duluth City Council resolution pursuant to Duluth City Code Section 31-8.
