CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from James C. Utick and Cindy L. Utick, a perpetual easement for street and utility purposes over, under, and across the real property described and depicted on Exhibit B to the attached Exhibit 1. 

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for street and utility purposes from James C. Utick and Cindy L. Utick (the “Uticks”) over, under, and across certain property in the Hunters Park neighborhood for nominal consideration.  The approximate location of the easement area is outlined in red on the map attached as Exhibit 2 and is located at the intersection of St. Andrews Street and Abbotsford Avenue (undeveloped).  

 

The City will be replacing the bridge at Tischer Creek underneath St. Andrews Street as soon as the State of Minnesota passes a bonding bill.  This work includes replacing a triple set of culverts that control the flow of Tischer Creek.  A portion of this bridge lies outside of the platted right-of-way and within the boundary of the Uticks’ property.  The City needs this easement in order to perform this work and maintain the bridge and infrastructure.
