RESOLUTION SUBMITTING PROPOSED ORDINANCE TO VOTERS AT SPECIAL ELECTION ON NOVEMBER 8, 2022 AMENDING AND INCREASING THE PARKS FUND SPECIAL LEVY FROM A FIXED AMOUNT OF $2,600,000 ANNUALLY TO A FIXED PERCENTAGE OF 0.0472654 ANNUALLY ON THE REFERENDUM MARKET VALUE OF ALL TAXABLE PROPERTY WITHIN THE CITY AND SETTING THE BALLOT QUESTION FOR THE NOVEMBER 8, 2022 ELECTION

CITY PROPOSAL:

                     RESOLVED, that the city council hereby submits the following proposed ordinance, said ordinance which was approved by city council on August 15, 2022 as 22-026-O, to the qualified voters of the city of Duluth at the general election to be held on Tuesday, November 8, 2022, for their approval or rejection in the manner provided for by law.

                     RESOLVED FURTHER, that the city clerk shall place upon the ballot at such general election the proposition hereinafter set forth.

City of Duluth Question

APPROVAL OF DEDICATED PARKS FUND LEVY INCREASE

The city has an existing parks fund levy set as a fixed annual dollar amount of $2,600,000 on the referendum market value of all taxable property within the city, which is 0.0290052 percent on the referendum market value of all taxable property within the city for the year 2023. The current parks fund levy is applicable indefinitely unless otherwise revoked or reduced as provided by law.  Should the city increase its parks fund levy to a new fixed annual percentage amount of 0.0472654 percent on the referendum market value of all taxable property within the city, which is $4,236,821 on the referendum market value of all taxable property within the city in 2023, and end the entire parks fund levy referendum revenue authorization in twenty-five (25) years at the end of the year 2047, unless otherwise revoked or reduced as provided by law? The sole purpose of the parks fund levy is funding parks and recreation facilities and activities.            0 YES         0 NO      

BY VOTING “YES” ON THIS BALLOT QUESTION YOU ARE VOTING FOR A PROPERTY TAX INCREASE.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution directs placement of an ordinance amendment approved by City Council on August 15, 2022 as 22-026-O on the November 8, 2022 general election ballot.  The ordinance amendment changed the Parks Fund Levy referendum revenue from a fixed annual amount of $2,600,000 to a fixed 0.0472654 percentage on all taxable property within the city.   Pursuant to a motion to amend by Councilor Randorf on July 18, 2022 approved by City Council, the entire Parks Fund Levy referendum revenue authorization will end in twenty-five (25) years at the end of year 2047.

 

A major function of the resolution is to set the specific language of the referendum question that will appear on the ballot.

 

The language of the referendum question was drafted by the City Attorney’s Office to meet the requirements of Laws of Minnesota, 1953, Chapter 560, Section 1, Minnesota Statutes Section 275.60, 275.61, Minnesota Administrative Rules 8250.1810, and applicable Minnesota cases.
