ORDINANCE AMENDING SECTION 9-2 AND SECTION 9-3 OF THE DULUTH CITY CODE TO CLARIFY DEFINITIONS AND PROHIBIT RIDING BICYCLES, ELECTRIC-ASSIST BICYCLES, WHEELED RECREATIONAL DEVICES, AND MOTORIZED FOOT SCOOTERS ON PORTIONS OF THE LAKEWALK AND BAYWALK AT MORE THAN 10 MPH.

BY COUNCILORS TOMANEK, FORSMAN AND MAYOU:

                     The city of Duluth does ordain:

                     Section 1.                     That Section 9-2 of the Duluth City Code be amended as follows:

                     Sec. 9-2.                     Definitions.

                     For the purposes of this Chapter, the following words and phrases shall have the meaning respectively ascribed to by this Section:

                     Bicycle. A bicycle shall have the same definition as provided in Minn. Stat. Section 169.011 Subd. 4, as amended. Every device propelled by human power upon which any person may ride, having two tandem wheels either of which is over 14 inches in diameter, and including any device generally recognized as a bicycle though equipped with two front or rear wheels.

                     Bicycle lane.  A bicycle lane shall have the same definition as provided in Minn. Stat. Section 169.011 Subd. 5, as amended. A lane for bicycles, electric-assisted bicycles, and motorized foot scooters established within the portion of a street or highway easement which has been improved for vehicular traffic.

                     Bicycle path.  A bicycle path shall have the same definition as provided in Minn. Stat. Section 169.011 Subd. 6, as amended.  A path for bicycles, electric-assisted bicycles, and motorized foot scooters established on that portion of a street or highway easement which has not been improved for vehicular traffic or on other property owned by the city.

                     Business District.  Business District shall have the same definition as provided in Chapter 33-1 of this Code.

                     Electric-assisted bicycle.  Electric-assisted bicycle shall have the same definition as provided in Minn. Stat. Section 169.011 Subd. 27, as amended.

                     Motorized foot scooter.  Motorized foot scooter shall have the same definition as provided in Minn. Stat. Section 169.011 Subd. 46, as amended.

                     Wheeled recreational device.  A wheeled recreational device is a device propelled by human power or battery used for recreation or play, including skateboards, inline skates, roller skates, and one wheeled balance boards.

                     Section 2.                     That Section 9-3 of the Duluth City Code be amended as follows:

                     Sec. 9-3                     Riding Restrictions

                     (a)                     No person shall ride a motorized foot scooter or electric-assist bicycle on any sidewalk, except when necessary to enter or leave adjacent property.

                     (b)                     No person shall ride a bicycle, electric-assisted bicycle or motorized foot scooter on any street, sidewalk, roadway, public path or public property where signs have been erected prohibiting bicycle, electric-assisted bicycle or motorized foot scooter riding.

                     (c)                     No person shall ride a bicycle upon a sidewalk within a business district.

                     (d)                     No person shall operate a bicycle, electric-assist bicycle, motorized foot scooter or wheeled recreational device at a speed greater than 10 miles per hour on the following portions of the Lakewalk and Baywalk: Upon the trail known as the Baywalk, from approximately the intersection of Harbor Drive and the Minnesota Slip Bridge to the Duluth Lift Bridge, and upon the trail known as the Lakewalk, from the Duluth Lift Bridge to the Duluth Rose Garden, including all adjacent and connecting pathways and park spaces.

                     (de)                     Except as prohibited by this section or state law, a person may ride a bicycle, electric-assisted bicycle, or motorized foot scooter on any street, sidewalk, roadway, public path, or trail.                     

.                     Section 3                     That this ordinance shall take effect and be in force 30 days from and after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this ordinance is to set the maximum speed people can ride bicycles, electric-assisted bicycles, wheeled recreational devices and motorized foot scooters on portions of the baywalk and the Lakewalk to 10 mph.  The ordinance also adopts the state statute definitions of bicycle, bicycle lane and bicycle path and defines wheeled recreational devices.
