CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the Duluth Economic Development Authority, an economic development authority under the laws of the State of Minnesota, Chapter 469, a perpetual easement for utility purposes over, under, and across the real property legally described on the attached Exhibit 1.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a permanent easement for utility purposes from the Duluth Economic Development Authority (“DEDA”) over, under, and across certain property in the Lincoln Park neighborhood for nominal consideration. The utility easement is located near the intersection of 10th Avenue West and Third Street near Observation Park. DEDA is working with One Roof Community Housing to develop this site for housing purposes, and it was discovered that the City’s existing gas line did not have an easement. A map depicting the approximate easement area is attached as Exhibit 2.
