CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from Dirt, Inc., a perpetual easement for street purposes over, under, and across the real property legally described and depicted on Exhibit B to the attached Exhibit 1. 

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for street purposes from Dirt, Inc. over, under, and across certain property in the Duluth Heights neighborhood for nominal consideration.  The street easement is needed in connection with the upcoming housing project for CIC Plat #152 (Cottage Hill Common Interest Community) (the “Project”) located off of Decker Road and will provide access from Decker Road to property located adjacent to and west of Dirt, Inc.’s property.  The Development Agreement governing certain terms and conditions of the Project required the granting of this street easement.
