RESOLUTION AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF DULUTH AND THE MINNESOTA DEPARTMENT OF TRANSPORTATION FOR UTILITIES AND CONSTRUCTION.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute an agreement substantially in the form of the attached Exhibit A between the city of Duluth and the Minnesota Department of Transportation (MnDOT) for utilities and construction to be performed upon, along, and adjacent to Trunk Highway 23 from 1.35 miles east of Trunk Highway 210 to Trunk Highway 39 within the city limits under State Project 6910-105 (city project No. 2136), and at estimated cost of $5,000 payable from water fund 510.
FURTHER RESOLVED, that the mayor and Cindy Voigt, City Engineer, are authorized to execute the agreement and any amendments to the agreement.
Statement of Purpose
STATEMENT OF PURPOSE: MnDOT will be constructing roadway improvements adjacent to Trunk Highway 23 from 1.35 miles east of Trunk Highway 210 to Trunk Highway 39. And with that work, the city will be required to reimburse MnDOT for water gate valve adjustments. This agreement provides for the city to reimburse MnDOT for its share of the utility, adjustments to be performed in 2023. Given the city share is estimated we added a small contingency to the resolution. The city share for the gate value adjustments will be paid from water fund 510.
