RESOLUTION VACATING ALL OF PLATTED 5TH AVENUE WEST (KNOWN AS 60TH AVENUE WEST) EXCEPT THE NORTH 30 FEET.

CITY PROPOSAL:
RESOLVED, that the city council finds the following::
(a) A sufficient petition was filed with the city requesting the vacation of the street easement described in paragraph (e) below; and
(b) Pursuant to Section 100 of the City Charter and Section 50-37.6 of Chapter 50 of the Duluth City Code, as amended, such petition was duly referred to the city planning commission (file number PL 22-221) and such commission gave due notice of public hearing and did consider same in a public hearing and the city planning commission found that the portions of the platted street and alley easements leally described in paragraph (e) below are useless for vehicular and pedestrian purposes but that the below-described portion of street easement should be retained for utility purposes; and
(c) The city planning commission, at its January 10, 2023 regular meeting, recommended approval of the vacation petition subject to the retention of the aforesaid easement for utility purposes; and
(d) That the portions of the street easements proposed to be vacated:
(1) Are not and will not be needed for the safe and efficient circulation of automobiles, trucks, bicycles, or pedestrians in the city; and
(2) Are not otherwise needed to promote the public health, safety or welfare of the citizens of Duluth.
FURTHER RESOLVED, that the city council of the city of Duluth approves the vacation of the that part of 5th Avenue East which lies Southerly of the Westerly extension of the Northerly line of Block 296 and which lies Northerly of the Westerly extension of the South line of Block 296, West Duluth 4th Division, except the North 30 feet thereof, all as legally described and depicted on the attached Exhibit 1.
