CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute a three-year lease agreement, substantially the same as the agreement attached as Exhibit 1, with the Plant-A-Lot Community Garden Program, for the use of multiple, vacant real properties for operation of its community garden program.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a new, three-year lease agreement with Plant-A-Lot Community Garden, d/b/a Duluth Community Garden Program ("DCGP"), for use of multiple, vacant real properties to operate its community garden program. DCGP connects people of the local community together through the growing and sharing of food through urban gardens so that anyone, regardless of resources or experiences, can have a place to grow fresh produce. DCGP's services include providing 400 sq. foot garden plots; loaning out garden tools, books, and food preservation equipment; and hosting educational classes and garden tours.

DCGP shall lease the real properties from the City at no cost. The consideration for the lease shall instead be the public benefit provided by DCGP through its community garden program and operations. Under the terms of the lease agreement, DCGP is responsible for all duties and costs associated with the use of the properties, including maintenance and utilities. The City reserves the right to terminate the lease if DCGP abandons the properties or ceases to use them for its community garden program. The sites covered by this new lease are depicted on maps attached as Exhibit B to the lease agreement attached as Exhibit 1.
