RESOLUTION AUTHORIZING THE FIRST AMENDMENT TO AGREEMENT L31129 WITH THE DULUTH ENTERTAINMENT CONVENTION CENTER (DECC) FOR ESTABLISHMENT OF A MULTI-YEAR FEE STRUCTURE FOR BAYFRONT FESTIVAL PARK.

 

Body

CITY PROPOSAL:

WHEREAS, resolution 24-0992R authorized the proper City officials to enter into a five-year agreement with the DECC for management of the Bayfront Festival Park; and

 

WHEREAS, Section VII. Financials, Reporting, and Taxes in agreement (City contract No. L31129) directs the City and DECC to establish a multi-year fee structure for Bayfront Festival Park; and

 

WHEREAS, both parties desire to amend the agreement to establish a multi-year fee structure;

 

NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to execute the first amendment, substantially in the form attached as Exhibit A, to the existing management agreement (City contract No. L31129), with the Duluth Entertainment Convention Center for the continued operation and management of Bayfront Festival Park.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the first amendment, substantially in the form of Exhibit A, to the existing management agreement (City contract No. L31129) with the Duluth Entertainment Convention Center for the continued operation and management of Bayfront Festival Park. The amendment establishes a multi-year fee schedule, attached to the agreement as Exhibit F.

Establishing multi-year rates supports the DECC in attracting, negotiating, and securing events at Bayfront Festival Park on a longer timeline than has been possible with the standard City fee schedule approval process. Fees paid to the City are deposited into the Bayfront Enterprise Fund, a restricted fund designed to reinvest in capital improvements at Bayfront Festival Park.
