AN ORDINANCE DEDICATING A PERPETUAL EASEMENT FOR HIGHWAY PURPOSES OVER CITY-OWNED PROPERTY.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That the city of Duluth does hereby dedicate to the general public a perpetual easement for highway purposes over, under and across real property located in St. Louis County, Minnesota legally described and depicted on the attached Exhibit A.
Section 2. That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the easement to be dedicated.
Section 3. That this ordinance shall take effect 30 days after its passage and publication.

Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this ordinance is to dedicate a perpetual easement for highway purposes across certain city-owned property near London Road and 27th Ave. East at the Lakewalk Trailhead.

The easement consists of two areas: (i) a 10 x 100 foot strip of land abutting the State of Minnesota Department of Transportation's ("MnDOT") right-of-way for London Road ("Easement Area 1") and (ii) a 50 x 115 foot strip of land adjacent to 27th Ave. E. ("Easement Area 2"). Easement Area 1 and Easement Area 2 are collectively referred to as the "Easement Area."

Easement Area 1 is needed to be dedicated in connection with MnDOT's upcoming project for London Rd. so that MnDOT can take over it through Commissioner's Orders. The Second Easement Area is need by MnDOT for the same purposes, but also for the City in connection with its upcoming project for Lakewalk reconstruction and shoreline resiliency work funded under a Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grant from the United States Department of Transportation.
