CITY PROPOSAL:
RESOLVED, that the city council approves settlement of the matter of City of Duluth vs. Cave Enterprises Operations, LLC, venued in the sixth judicial court, state of Minnesota, file no. 69DU-CV-25-822, pursuant to the terms and conditions of a settlement agreement substantially in the form of that attached hereto as Document A.
FURTHER RESOLVED, that the proper city officials are authorized to take all actions necessary to conclude this matter on a full, final, and complete basis; payment of $20,000 to be paid into fund no. 110-110-1104-4654-02.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes city officials to enter into and implement the Settlement Agreement in City of Duluth vs. Cave Enterprises. City administration and the city attorney recommend approval of this settlement agreement.
