Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to request and accept from St. Louis County, on behalf of the State of Minnesota, the following described tax-forfeited lands located in St. Louis County, Minnesota, to be used for road purposes:

Lots 1 and 2, Block 5, CITY HOME ACRES

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all required documents in connection with the request and acceptance of the real property described above and pay all administrative fees, recording fees, and other costs associated with the conveyance; payable from Fund 110-500-1930-2330-5441 (City Project No. 2340).

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the request of and accept a tax-forfeited parcel (the “Parcel”) from St. Louis County, on behalf of the State of Minnesota, to be used for road purposes.

The Parcel abuts Ideal Street in the Duluth Heights neighborhood.  The City desires to acquire the Parcel in connection with a 2027 project for the reconstruction of Ideal Street between Eklund Ave. and Swan Lake Road (the “Project”).

As part of the Project, the City needs to construct and maintain a drainage basin close to Ideal Street.  The City desires to acquire the Parcel to install and maintain this drainage basin.  The acquisition of the Parcel will be a free conveyance under Minn. Stat. § 282.01, Subd. 1a(e)(1).  The City will be responsible for paying the state’s administrative costs, recording fees and deed tax associated with the transaction.

The Parcel is outlined in red on the map attached as Exhibit A.
