RESOLUTION AUTHORIZING A PERMIT FROM ST. LOUIS COUNTY, FOR THE TEMPORARY USE OF PROPERTY ABUTTING ST. MARIE ST. IN THE CHESTER PARK-UMD NEIGHBORHOOD, AT NO COST TO THE CITY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into and execute a permit, substantially the same as the agreement attached as Exhibit 1, from St. Louis County, on behalf of the State of Minnesota, for the temporary use of certain real property abutting St. Marie St. in connection with the upcoming reconstruction of St. Marie St., at no cost to the city.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a permit, substantially the same as the agreement attached as Exhibit 1, from St. Louis County, on behalf of the State of Minnesota, for the temporary use of certain real property abutting St. Marie St. in the Chester Park-UMD neighborhood, at no cost to the City. The permit is needed to make improvements related to the Campus Connector Segment 5 project.
The City will be constructing a shared use path on St. Marie St. between Woodland Avenue and Vermilion Road. The 50-foot wide stretch of St. Marie St. between Wallace Avenue and Vermillion Road abuts two tax-forfeit parcels, which the City is acquiring portions thereof. The City Council previously authorized the acquisition of the property subject to this permit under Resolution No. 26-0601, but the acquisition process takes 3-6 months. The City needs permission in advance of the acquisition to perform certain elements of the project, and this permit allows the City to proceed with plan approval and bidding without any delays.
The term of this permit is through December 31, 2027, which is required under the funding source for the project; although it will terminate upon the City’s acquisition of the property. The permit requires the City to indemnify St. Louis County. Council approval of the permit is needed for these two reasons.
