RESOLUTION AUTHORIZING MUNICIPAL CONSENT TO ST. LOUIS COUNTY FOR THE RICE LAKE ROAD CORRIDOR PROJECT - PHASE 1.

 

Body

CITY PROPOSAL:

 

WHEREAS, St. Louis County, in partnership with the City of Rice Lake, is leading the Rice Lake Rd Corridor Project which will reconstruct portions of Rice Lake Rd (CSAH 4), Martin Rd (CSAH 9), West Calvary Rd (CR 234), and construct new city streets and paved trails located within the cities of Duluth and Rice Lake; and

 

WHEREAS, The Rice Lake Rd Corridor Project will be constructed in two phases with the first phase (Phase 1) to construct a paved trail along the east side of Rice Lake Rd (CSAH 4) beginning at Norton Rd and ending at Ridgeview Rd (CR 694) including resurfacing Old Rice Lake Rd (CR 162) and is identified as SP 069-604-086, CP 0004-981495, and the second phase (Phase 2) will construct the remainder of the project and is identified as SP 069-604-093, CP 0004-490685; and

 

WHEREAS, Phase 1 is anticipated to be constructed in 2027, and Phase 2 is anticipated to be constructed in 2028 through 2030; and

 

WHEREAS, Minnesota Statutes §162.02, Subd. 8 states no portion of the county state aid highway system lying within the corporate limits of any city shall be constructed, reconstructed, or improved nor the grade thereof changed without the prior approval of the plans by the governing body of such city and the approval shall be in the manner and form required by the commissioner; and

 

WHEREAS, Phase 1 is located entirely within the City of Duluth and the construction plan for Phase 1 has been presented to the Duluth City Council, copies of which were before the council; and

 

WHEREAS, The City of Duluth does not have any share of the construction cost for Phase 1.

 

THEREFORE, BE IT RESOLVED, that the City Council of Duluth, Minnesota hereby approves of the construction plan for Phase 1 of the Rice Lake Rd Corridor Project and that this approval will serve as municipal consent to satisfy the requirements of Minnesota Statutes §162.02, Subd. 8.

 

Statement of Purpose

STATEMENT OF PURPOSE: St. Louis County has submitted the construction plan for Phase 1 of the Rice Lake Road Corridor Project to State Aid for review and approval. This project requires municipal consent from Duluth.
