RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR ROAD AND UTILITY PURPOSES FROM ST. LOUIS COUNTY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for road and utility purposes over real property described on the Easement Agreement attached as Attachment 1 from St. Louis County, Grantor, over the following described property in St. Louis County, Minnesota as depicted in Exhibit A to Attachment 1:
“Easement 1:” Beginning at the southwest corner of Lot One (1); thence easterly 40.00 feet along the south line of Lots One (1) and Two (2), to a point, said south line is an arc concave to the south and said south line is the north right of way of Restormel Street with centerline radius of 528.25 feet; thence northwesterly to a point on the west line of said Lot 1 that is 40.00 feet north of the southwest corner of Lot 1; thence south 40.00 feet along the west line of said Lot 1 to the point of beginning
And
“Easement 2”: Beginning at the northwest corner of said Lot 1, thence easterly 15.00 feet along the north line of said Lot 1 to a point; thence southwesterly to a point on the west line of said Lot 1 that is 15.00 feet south of the northwest corner of said Lot 1; thence north 15.00 feet along the west line of said Lot 1 to the point of beginning.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a permanent road and utility easement over a portion of property. No formal easement granting the city a road and utility easement for Devonshire Street Alley was ever recorded. This area has been used as a gravel alley for many years. The city is now formally obtaining the right to plow and maintain.
